娱美德签署授权相关的声明

娱美德娱乐有限公司(以下简称“娱美德”)针对2017年4月10日，有一些报道称亚拓士有限公司(以下简称“亚拓士”)发布声明，主张前述授权系非法行为。此主张是与事实相悖的，所以娱美德公司特此声明。

未经娱美德授权的79款游戏已经被苹果的App Store最终认定为违法的侵权游戏，已被苹果作出了下架处理。包括盛大(包括蓝沙)等授权的《传奇天下》、《轩辕传奇》、《决战热血沙城》、《传奇王者HD》、《烈火轩辕》等。

娱美德公司声明

Wemade’s Announcement

2017年3月31日，娱美德娱乐有限公司(以下简称“娱美德”)与上海时与光网络科技有限公司(以下简称“时光科技”)签订授权协议，授权时光科技在中国大陆地区通过合法渠道推广时光科技使用《热血传奇》游戏元素改编的一款自主研发的手机游戏。2017年4月10日，有媒体报道称，亚拓士有限公司(以下简称“亚拓士”)发布声明，主张前述授权系非法行为。根据中国的法律，亚拓士的主张是与事实相悖的。娱美德公司特此声明如下：

On March 31, 2017, Wemade Entertainment Co., Ltd (“Wemade”) and Shanghai Time Network Technology Co., Ltd. (“Time Tech”) entered into a license contract in which Wemade granted to Time Tech a license to develop a mobile game using the intellectual property of “Legend of Mir 2” (in Chinese “热血传奇”) in the Territory. On April 10, 2017, according to some reports, Actoz Soft (“Actoz”) delivered a statement that the above-mentioned license is an illegal action (“Statement”). However, pursuant to the laws and regulations of China, Actoz’s claim contradicts the facts. Thus, Wemade hereby announces the following:

一、娱美德作为《热血传奇》游戏的共同著作权人，对时光科技进行的授权合法、有效，不侵犯任何第三方合法权益。亚拓士作为《热血传奇》游戏的共同著作权人无论根据中国还是韩国的法律均无权阻止娱美德对时光科技的授权，亚拓士的声明不属实，，存在大量误导性内容，同时违反了中国和韩国的著作权法律。

As Wemade is the co-owner of the Legend of Mir2 (in Chinese the “热血传奇”), Wemade’s license to Time Tech is legitimate and valid, and it does not constitute infringement against any intellectual property of third parties. Actoz, the other co-owner of the Legend of Mir2, has no right to prevent Wemade’s license to Time Tech pursuant to the laws and regulations of China and South Korea. Actoz’s Statement is not true and is full of misleading information, and such statements violate the copyright laws of China and South Korea.

二、娱美德已经开始对未经娱美德授权的中国山寨传奇游戏进行维权，未经娱美德授权、而自称获得了盛大(包括蓝沙)等授权的《传奇天下》、《轩辕传奇》、《决战热血沙城》、《传奇王者HD》、《烈火轩辕》等共计79款游戏已经被苹果AppStore下架。亚拓士从未单独向包括盛大在内的任何中国公司授予根据《热血传奇》开发并运营新游戏的授权。娱美德呼吁游戏同行警惕包括盛大在内的任何主体假借亚拓士的名义并谎称已取得娱美德授权而进行的违法授权行为。

Wemade has already started protecting its rights and interests against many copycat Mir games in China and a total of 79 games including “传奇天下”、“轩辕传奇”、“决战热血沙城”、“传奇王者HD”、“烈火轩辕”, which claimed to have received Shanda (and LANSHA)’s authorization and not that of Wemade, have already been removed from Apple’s AppStore. Actoz has never separately authorized any Chinese game companies, including Shanda, to develop and service new games using the intellectual property of the Legend of Mir2. Wemade hereby calls for strong warning on any illegal authorizations from Shanda and any other companies which grants authorization on the false pretenses of Actoz and also falsely claims it has obtained the license from Wemade.

三、娱美德提醒中国游戏行业的同仁们注意，目前亚拓士的前任和现任高管(均由盛大委派)正在接受韩国警方和检察机关的刑事调查的事实。

Wemade also hopes to draw Chinese game companies’ attention to the fact that several former and current senior management members of Actoz(appointed by Shanda) are currently under criminal investigation by South Korean police and prosecutors.
